All equipment for Hire Purposes remain the SOLE property of Solace Mobility Rentals Ltd.

  1. If required the equipment is to be delivered to Hirer and then picked up by Solace at the Hirers risk within a 15 mile radius. A periodic rental rate is charged by Solace. Rental charges are billed to the Hirer for each period or portions of the period from the time the equipment is delivered to Hirer until its return. If a term rental rate is charged by Solace, rental charges are billed to the Hirer for the full term even if the equipment is returned before the end of the term or not fully used as equipment is off Solace’s premises. No refund will be offered by Solace and all monies from the hire and deposit will remain with Solace. If the equipment is not returned during or at the end of the term, then the Hire charges shall continue on a full term basis for any additional term or portion thereof until the equipment is returned. If no contact is made by the Hirer, then the equipment will be classed as stolen and full recompense will be added to the Hirer’s bill.
  2. The Hirer shall pay full recompense if Hirer terminates the contract between Solace and themselves due to illness, accidents or unforeseen circumstances if outside a 48 hour notice time period from the Hirer’s date and time the Hire period was to commence. Deposit shall be refunded at Solace’s discretion. No waiver whatsoever will be attributed to the above.
  3. The Hirer shall pay the costs of delivery, costs to be included in the initial payment on Solace’s website. If the Hirer is not available on the premises to pickup the equipment on the day of collection or at the end of the rental period on the specified day and time slots, the rent shall continue until equipment is collected and will be charged accordingly.
  4. Hirer shall assume full responsibility of the terms and conditions if picking up rental equipment from ‘Solace’s’ premises for the specified rental dates. Inclusive of (1.Terms)  The period of Hire will start from time of delivery or attempted delivery and time of collection from ‘Solace’s’ premises. It is the responsibility of the Hirer to ensure someone is on the premises to receive the equipment, details of days and times are on our web site. It will be the Hirer’s responsibility from the completion of delivery or pick up, until either collected by Solace as per the contract or dropped off at Solace’s premises as per the contractual agreement on Solace’s website. The hirer shall keep and maintain the rented equipment in the same condition when it was either delivered by Solace or picked up by Hirer during the terms of the rental at their own cost and expense.You shall keep the equipment in a good state of repair, normal wear and tear expected and accepted, but limited to scuffs and scrapes.
  5. Soft furnishings if soiled will incur an additional £25.00 surcharge for cleaning.
  6. The Hirer shall not remove the equipment from the address of the Hirer or the location shown herein as the place of use of the equipment without prior written approval of Solace. If Solace perceives this to be the case, then the equipment shall be removed from the new location by Solace and the Hirer will incur all costs Solace deems applicable and the deposit shall be forfeit.
  7. The Hirer shall inform Solace of the exact location of the equipment while it is in the Hirers possession by filling out the delivery address form on the Solaces website along with billing address which MUST be linked to an active debit/credit card. If the card is not linked to the billing address, then Solace will not under any circumstances allow its equipment to be rented unless an active debit/ credit card is presented with the correct billing address it is linked to.
  8. The Hirer shall allow Solace to enter Hirers premises where the rented equipment is stored or used at all reasonable times to locate and inspect the state and condition of the rented equipment during or after the rented time agreement and is deemed in default of any of the terms and conditions of this agreement, Solace, at the Hirers risk, cost and expense may remove all rented equipment supplied by Solace on or before the end of the agreed rental period. Hirer will then forfeit all returnable monies.
  9. During long term rental of any of Solaces equipment, Solace reserves the right to inspect periodically with arranged date and times its equipment for signs of misuse, negligence, excessive wear and tear and its use is in accordance with its intended use and manufacturers recommendation.
  10. It is the Hirers responsibility to ensure that the equipment Hired, will FIT through DOORWAY’S and ACCESS points at the property, taking note of all measurements and weight of the equipment they are Hiring to ensure a safe and successful delivery and collection to avoid injury. If the equipment is to be picked up at Solace’s premises then the same applies as above.
  11. It is the Hirers responsibility to ensure they fully understand each piece of equipment they are Hiring will have a certain weight capacity for lifting and manual handling, Solace will not be held responsible for any injury incurred no matter how minor to the Hirer or people associated with the Hirer due to not understanding the weight, size nor shape of the equipment hired, which can lead to miss handling and damage to themselves, any other persons assisting and or misuse of the equipment.
  12. Solace will not be held responsible nor liable from any infraction whatsoever by minors or pets of any description should they inadvertently come to harm during the Hire of Solace’s equipment due to the negligence of the Hirer or other parties present who do not act with vigilance to ensure safety at all times.
  13. The Hirer will take care on pickup and delivery of the equipment not to damage property, decor or transportation vehicle whether its a private vehicle or Hirer has retained outside assistance with the delivery and pickup of Solace’s equipment. Solace will not be liable for any accidental damage caused by any manual handling by Hirer or persons thereof  to assist them. Deposit money or monies may not be returned to Hirer at the end of the contract if Solace deems more damage has been done to Solace’s equipment due to miss management and handling over and above general wear and tear.
  14. Solace will ensure at all times equipment is delivered and picked up with due care and attention, not to damage the internal or external fabric of the building or decor. Solace will not be liable for any accidental damage caused if hirer is insistent the item be delivered which goes against Solaces safety standards. If Solace deems health and safety is compromised then the equipment will not be available for rental and deposit may be forfeited.
  15. It is the Hirers responsibility to ensure that equipment Hired is able to properly be installed within the Hirers premises, or within any premises that the Hirer will be located and in the correct environment to avoid misuse and potential safety issues.
  16. The Hirer is responsible for making sure that when using the equipment, that he/she complies with all relevant legislation and health and safety requirements by signing an equipment hire agreement which clearly states the Hired equipment was shown to Hirer on the use of and any specific requirements to insure safe operation and to charge safely if required and by what method before Solace’s departure.
  17. All electrical items which need to be either charged or plugged into a mains outlet must adhere to all the correct voltage and wattage instructions. Solace will not be held responsible nor liable for any incorrect  power source used resulting in the equipment either damaged or broken. This will result in the Hirer forfeiting any deposit and replacing the equipment like for like.
  18. All electrical equipment must be disconnected from a mains supply before cleaning, charging adapter removed from the charging slot. (Hands must be thoroughly dry before reconnecting to the mains supply)
  19. Solace will not be held accountable for any of its equipment being used in adverse weather conditions which is not suitable for the Hired equipment, rendering it dangerous to both the Hirer and any other person thereof, which can potentially cause unforeseen accidents. Solace will permit no accountability for the weather during the Hired period, regardless of the time of year and will not condone misuse or inappropriate handling for which the equipment is not viable for.
  20. Risk Protection:
  21. Any equipment hired from Solace whether it be a mobility battery powered vehicle, the classification ‘invalid carriage’ or under manual power will be required to have full comprehensive insurance from the Hirer. Solace will not cover any insurance claims by the Hirer whether it’s from misuse, third party damage or negligence. Proof of comprehensive insurance will be required before Solace’s equipment is taken possession of. This can be done via email, in good reasonable time before hire period, or on the day of hire, if no proof is produced then Solace reserves the right to cancel the hire and the hirer will forfeit part of their deposit to cover inconvenienced caused.
  22. Please insure with any Solace equipment that you are fully aware that each product has a limited capacity for user weight and specified dimensions that are listed with each item on our website, to avoid damage to equipment or to injure themselves. Solace will not be responsible for the Hirer not properly adhering to all important information which lists the dimensions and user weight before confirming their rental period.
  23. Hirer must not sell, rent to a third party for any kind of personal again or dispose of the product or any of its parts. Hirer must not give anyone any legal rights over the product.
  24. Hirer must not let anyone work on the product. Hirer will immediately notify Solace of any breakdown or if the product is defective or damaged in any way and without any attempt to repair. The Hirer shall not attempt to use any faulty equipment or take it upon themselves to use it in such a way as to potentially cause harm to themself or any other person/persons.
  25. Hirer must let Solace know as soon as they become aware of any defect(s) in the product. Hirer should use all available contact’s on the website to notify Solace of any defects within 2 days (48hrs) of the date of delivery.

HIRER/GUARANTOR/GUARDIAN or any AUTHORIZED user must not:

  1. Resell, Hire or Lend the product.
  2. Use the product for any illegal purpose.
  3. Use the product for any purpose for which it was not designed.
  4. Pledge or in any way charge by way of security for any indebtedness of any of the products.
  5. Use the product following a notification of a defect to Solace until such time as Solace visits the Hirer and effects repairs or replaces the product.
  6. The equipment shall NOT be taken Overseas and to reside ONLY in the UNITED KINGDOM and WILL only be permitted to be used in the UK. If taken outside of the UK there will be a 100% charge to replace the item from new.
  7. The Hirer shall at all times keep the equipment properly stored and protected by keeping the equipment indoors after use and or safely under outdoor cover (if using a motorised rider or equipment meant for the outdoors only) it is the Hirer’s responsibility to ensure any equipment left outdoors is securely locked and covered and not left in the outdoor elements to avoid damage and theft. Full recompense shall be sort by Solace if lack of care is taken by Hirer.
  8. Hirer must ensure that he/she keeps the product ON charge where rechargeable electrical batteries are fitted. If the batteries become defective due to not permanently on charge when not in use, then a charge will be applied to the Hirer for replacing the battery/ batteries by Solace.
  9. No allowance will be made for any rented equipment or portion thereof which is claimed not to have been used. Acceptance of returned equipment by Solace does not constitute a waiver of any of the rights Solace has under the 5 days limited rental agreement.
  10. Payment Terms:
  11. All payments for all equipment shall be made by an active debit/credit card on Solace’s Mobility Rentals website along with delivery charges and any money owed.
  12. The Hirers shall make available a current active credit or debit card to allow such charges to be collected and gives Solace unreserved permission to use this card.
  13. Payments for equipment and all applicable delivery and collection charges shall be made upon ordering on Solace’s website.
  14. If the Hirer fails to make payment on the website or AGREED due date, without prejudice to any other right or remedy available to Solace, Solace will be entitled to:
  15. Cancel the contract immediately and suspend any further supply of services to the Hirer until such time as the Hirer has paid in full including any incurred costs. Solace will recover any products already delivered to the Hirer for which payment has not been received and Hirer will pay the collection costs at Solace’s discretion. The Hirer shall not be entitled to withhold any payment (or part thereof) or make any deduction from the amount invoiced by Solace in respect of any set-off or counterclaim unless such deduction or withholding is agreed in advance by Solace in writing.
  16. The Hirer shall not pledge or encumber the rented equipment in any way. Solace may terminate this agreement immediately upon the failure of Hirer to make rental payments when due, or when Hirer’s filing for protection from creditors in any court of competent jurisdiction.
  17. The Hirer will continue to be charged (both before and after any judgement) the daily rate of equipment until initial payment is made in full and will be liable for reasonable legal charges incurred by Solace in the recovery amounts due.
  18. Guarantee:
  19. Guaranteed obligations: all monies, debts and liabilities of any nature from time to time due or owing from or incurred by the Hirer to Solace
  20. In consideration of Solace entering into this agreement, the guarantor/guardian guarantees to Solace that whenever the Hirer does not pay any of the guaranteed obligations as and when they fall due, the guarantor/guardian shall make due and punctual payment to Solace on demand of the guaranteed obligations.
  21. Guarantor/guardian will be required at all times with no exceptions when the person/ persons attempting to Hire Solace’s equipment are not within the age category necessary for the type of equipment they are Hiring, nor a person/persons unable to proceed and continue through the Hire process and present an active Debit/credit card.
  22. If the Hirer is 75 years old or over, a guarantor/guardian is required to sign the declaration agreement.
  23. The Hirer must be a minimum of 18 years old that is legally capable of entering into a legal binding contract or a parent/guardian must stand as guarantor on the contract agreement, (Abiding by all Solace’s Terms and Conditions)
  24. If the guaranteed obligations are or become, unenforceable, invalid or illegal, the guarantor/guardian agrees to indemnify and keep indemnified Solace in full and on demand from and against all and any losses, costs and expenses suffered or incurred by Solace arising out of, or in connection with, any failure of the Hirer to perform or discharge the guaranteed obligations.
  25. This guarantee is and shall at all times be a continuing security and shall cover the ultimate balance of all monies payable under this agreement, irrespective of any intermediate payment or discharge in full or in part of the Guaranteed Obligations.
  26. The Hirer will continue to be charged (both before and after any judgement) the daily rate of equipment until initial payment is made in full and will be liable for reasonable legal charges incurred by Solace in the recovery amounts due.
  27. Deposits if applicable will be fully refunded within 5-7 working days to Hirer from Solace.A one off debit/credit card charge of £3.00 will be taken for each rental for administration from the initial deposit or deposits once the Hirer collects, or item returned by Hirer to Solace and Solace is satisfied the equipment is in full working order and not damaged beyond repair but acceptable wear and tear. There will be a 100% charge of the item that was Hired by the Hirer if the equipment is cancelled after the acceptable 2 days (48hr) notice time period.
  28. Bank holiday’s shall not be an exception for non payment, it is the Hirer’s responsibility to foresee all bank holiday dates and make payment arrangements to Solace for equipment Hire in advance to avoid delayed payments, as Solace will not allow the Hire of any equipment regardless of circumstances.
  29. The liability of the guarantor under this guarantee shall not be reduced, discharged or otherwise adversely affected by:
  30. If circumstances are beyond Solace’s control then Solace will contact the Hirer as soon as reasonably possible to notify the Hirer that:-
  31. Solace’s obligations under the contract will be suspended and the time for performance  of Solace’s obligations will be extended for the duration of the event outside Solaces control. Where the event outside our control affects Solace’s delivery/pick up or Hirers pick up times and drop off dates and times, Solace will arrange new delivery agreement dates and times with the Hirer after the event outside our control is over or satisfied.
  32. If the equipment is requested for an extension, by the existing Hirer on the booking system of the days required, then you must go into our booking system on Solace Mobility Rentals website and book the same equipment in your possession for the new days you require, if it is booked by another Hirer, the equipment MUST be returned to Solace and the original collection date or return date will still apply.
  33. If the original equipment is not booked by another Hirer when an extension is needed through the booking system, a new Order ID and new payment will be given and requested on the extra days needed which will still be a minimum of 5 days, a new deposit will be required but refunded with the original deposit when collection and review of equipment is complete. Terms and conditions still apply on all equipment when an extension is required.
  34. The product MUST only be used by the person(s) named in the agreement, or by anyone Solace AUTHORIZES in writing.
  35. If the equipment becomes faulty but was in full working order when hired but became faulty within the Hire dates, then the Hirer will still have to pay the days that it was in full working order. The rest of the remaining days will be refunded at Solace’s discretion.
  36. Solace makes no warranty of any kind regarding the rented equipment, except that Solace shall replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. We will aim to replace the equipment within one working day, however circumstances with availability for same or generic equipment may vary, Solace will endeavor to replace like for like.
  37. If the Hirer has an accident he/she must immediately notify Solace and their own insurance company. The Hirer will seek the names and addresses of everyone involved, including witnesses. The Hirer should also make the product safe and secure and tell the police immediately if anyone is injured or there is a disagreement as to the facts. The Hirer must then fill in an accident report form (which must also be filled in if the product is stolen)  also fill out the body diagram form for injuries that accompanies the form. Photo evidence would also be required to assist with the incident. Send form to the address given as soon as practically possible. The Hirer shall remain liable irrespective of whether he has completed this form or not. The loss or misplacement of such forms or advising Solace did not present the forms will not be accepted.
  38. Hirer indemnifies and holds Solace harmless for all accidents & injuries to the person/persons as all equipment is shown on its use before handover to the hirer.  Damage attributable to misuse, negligence or accident for which we cannot be deemed responsible.
  39. You agree to be the SOLE person renting the Hired equipment and are fully responsible for any person/s who, with or without your consent, sit on, stand on or ride on the hired mobility equipment, and further you indemnify Solace for any legal prosecution from physical injury resulting to yourself or anyone else or any property
  40. By entering into a short term or a longer Hire agreement, and thereby accepting these terms and conditions you agree to release, waive, and discharge the right to seek medical reimbursement or the legal prosecution of Solace for any physical injury resulting or property damage from the use of the rental equipment provided by Solace.
  41. Solace will not be viable for any damage due to the use of the equipment at the Hirers premises or property as the Hirer would have been extensively shown the use of equipment and having signed the hire agreement.
  42. Nothing in any contract or these conditions shall exclude or limit either party’s liability for death or personal injury caused by negligence, for fraudulent misrepresentations or for any other liability which cannot be legally excluded or limited.
  43. Solace reserves the right to vary these TERMS:
  44. Solace may update these conditions periodically by giving the Hirer at least 30 days’ advance notice in writing (“Notice Period”) to the Hirer’s email address. If Solace makes a change to the contract which would reasonably be regarded as being to the Hirers material detriment, the Hirer may terminate the contract by giving Solace written notice within 14 days of receipt of notice of the change from Solace, such termination to take effect on expiry of the notice period.
  45. (Solace) will keep the HIRER/GUARDIAN OR GUARANTORS  personal information on the contract agreement as part of Solace Mobility Rentals Limited records to help  maintain and improve its administration and management. No personal information will be given to any other parties.
  46. Governing Law:
  47. The agreement is governed by the laws of England. Any dispute may be submitted to the non-exclusive jurisdiction of the English courts. If any provision of this agreement is or becomes invalid or unenforceable, the remaining provisions shall not be affected.
  48. IMPORTANT-You Should Read This Carefully:
  49. The Consumer Credit Act 1974 covers this agreement and lays down certain requirements for your protection which must be satisfied when the agreement is made. If they are not, the owner cannot enforce the agreement against you without a court order.
  50. The Act also gives you a number of rights. You can end this agreement by writing to the person you make your payments to and giving at least 1 months’ notice. In order to do this the agreement must have been allowed to run for at least 12 months, including 50% of the number of payments due from the date of the original agreement though this may include the period of notice. You will have to make all payments and pay any amounts you owe until the date the agreement comes to an end. If you would like to know more about your rights under the Act, contact either your local Trading Standards Department or your nearest Citizens Advice Bureau.
  51. Authorized and regulated by the Financial Conduct Authority FRN 706661 These terms and conditions are accepted by the HIRER and/or the GUARDIAN/GUARANTOR for Solace Mobility Rentals terms of use.
